in York, PA


General Summary:

Under the general supervision of the Vice President and Deputy General Counsel, assumes increasing responsibility for providing legal guidance and support for various WellSpan Health activities and issues, such compliance with state and federal health laws and regulations, business transactions, contract negotiation/drafting/review, corporate governance, HIPAA, privacy and security, real estate transactions, tax-exemption, human resources/civil rights, patient care issues, hospital medical staff matters, bioethics, graduate medical education and research, payor contracting and population health, antitrust, medical malpractice, policy development and review, and insurance. Assists in overseeing outside counsel. Participates in monitoring legislative and regulatory developments and providing education to board, management, physicians and other staff.

Duties and Responsibilities:
The following are essential job accountabilities:

1 Conducts legal research and analysis, develops and recommends legal strategies and practical solutions for a broad array of legal, regulatory and compliance matters that may face the WellSpan Health.

2 Reviews and/or drafts proposed contracts, assists in the negotiation of contracts, and provides legal guidance to ensure that contracts comply with legal requirements.

3 Provides legal advice with respect to corporate governance and administration, and assists in preparing or reviewing bylaws, minutes, resolutions, policies, procedures and forms.

4 Provides legal support and guidance for contracting with employed and independent providers, guided by a strong working knowledge of Stark Law, Anti-Kickback Statute, and IRS requirements.

5 Provides support for the WellSpan Health's risk management activities by anticipating and recommending actions to avoid or manage legal risks to the WellSpan Health.

6 Participates in monitoring legal developments, including proposed and existing legislation and regulations, and provides education to board, management, physicians and other staff.

7 Manages multiple, complex legal matters with minimal supervision.

8 Assists in various business transactions, affiliations, and joint ventures.

9 Assists in overseeing outside counsel, and in collaborating with other WellSpan Health consultants.

Required Skills

This position requires excellent oral and written communication skills and the ability to manage a heavy workload with minimal supervision within a dynamic, heavily regulated and face-paced environment.

The successful candidate will possess the ability to effectively prioritize multiple competing demands and work collaboratively within a team-oriented department.

Must be able to work collaboratively with internal clients while anticipating and guarding against legal risks to WellSpan Health.

Required Experience

5 - 10+ years’ experience in healthcare law; in-house experience or broad-based outside hospital counsel experience preferred.

We are seeking a seasoned professional knowledgeable in the areas of fraud and abuse, CMS and DOH regulations, human resources, contracting, risk, and business transactions.

License to practice law in PA or able to obtain license within one year
